Terms & Conditions

  1. Terms of Business

    • ​Prosico is operated by Greatlets Ltd, a company registered in England, company registration number  06511322 as part of the Albion Property Group.

    • This document constitutes an agreement between Prosico as part of Greatlets Ltd (also referred to as 'we', or 'us') and the Customer (also referred to as 'you’, 'Landlord’ or ‘Vendor'), the terms of which are set out below.

    • Each order for Services by the Customer shall be subject to these conditions. The Customer shall ensure that the order is complete and accurate.

    • This is a multi-agency agreement: we do not place any restrictions on you engaging the services of other agents during the term of your agreement with us. If you are already in an agreement with another agent when you instruct us, you should read the terms of your contract with them as you may find yourself liable for a fee to them even if we sell or let your Property.

    • The law (as outlined in the Estate Agents’ Act 1979) requires you to accept these terms and conditions in order to instruct us as your agent. You will be able to indicate your acceptance of these terms and conditions at the time of paying our fee.

  2. Terminology: within these Terms and Conditions the following words of phrases shall have the following meanings unless context dictates otherwise:

    • Property: the property you have instructed us to market for sale or rent.

    • Content: Property descriptions, photographs and any other related information

    • Services: Property advertising and associated services

    • Package: the Prosico services selected

    • Tenant: a person renting, or interested in renting, your property.

    • Buyer: a person buying, or interested in buying, your property.

    • Applicant: potential buyer or tenant as defined above.

    • Customer, Vendor, Landlord, You: the owner of the property or the person who is entitled to sell or let the property on the owner’s behalf.

  3. Marketing Your Property

    • We will market your Property in accordance with the Package you have purchased. For all Lettings Advertisements we will endeavour to have your advertisement live within one working day of receiving your correct completed details, payment, ID and proof of ownership.

    • We may advertise your Property in any other media at our absolute discretion.

    • Prosico reserves the right to display paid adverts on which ever media it deems suitable at any given time for most efficacious results.

    • Property Portals are not owned by us and we cannot guarantee that these websites will constantly be available, nor that they will constantly carry listings from us. The list of third-party websites may be subject to change without notice.

    • We cannot be held responsible for the actions, inactions, problems, errors or omissions of third parties that affect the delivery of the whole or part of any of our services. Should a third-party service be unavailable for any reason, we will seek alternative services without unreasonable delay. At our sole discretion we may offer a whole or partial refund.

    • Our responsibility is strictly limited to the marketing of the Property. We are not responsible for any aspect of a subsequent let or sale.

    • All Packages are continuous from the commencement date. Once Service has started, refunds cannot be issued. You may cancel your advertisement at any time.

    • All packages are valid for 12 months from date of purchase unless otherwise stated in writing.

    • We reserve the right to suspend the Service, if: a) we have reason to believe a Property is no longer available, b) an advertisement does not generate Applicants within a reasonable time frame; c) we have reason to believe an advertisement is not genuine, for example where there are no Applicants or where all Applicants are rejected; d) where it is regarded that the property advertised is not at a realistic market price for its location, type or condition; e) where it is obvious or likely that a subsequent property has been substituted.

    • You are wholly responsible for the Content of your advertisements. We do not accept any liability for Content including omissions, errors or inaccuracies.

    • You agree without reservation to indemnify us, our proprietors, employees, subcontractors or agents against any claim made in respect of any mis-description or illegal Content that arises wholly or partially out of your act or default.

    • To ensure compliance with the terms of the Consumer Protection from Unfair Trading Regulations 2008 (CPRs) and the Business Protection from Misleading Marketing Regulations 2008 (BPRs) you will ensure Property descriptions are accurate.

    • Advertisements must not discriminate against any protected characteristic as outlined by the Equalities Act 2010. If we believe content may be in breach of this requirement, we reserve the right to edit or remove content in order to ensure compliance.

    • Editing of a live advertised property will be at the sole discretion of Prosico and may be limited to one edit per week.

    • You must not include any personal contact details in any part of the advertisement.

    • We hold your details solely for the marketing of your Property. We will not pass your details to any other party.

    • You undertake that you will not pass any personal data of any Applicant to any third party.

    • All Content provided by the Customer will be stored by us at an onsite location, backed up to the cloud, for 3 years.

    • We reserve the right to suspend marketing of a Property or a Customer's account at any time to allow us to investigate a suspected breach of our terms or unauthorised or fraudulent use of our services.

  4. Management of Advertisements​
    Unless otherwise specified in the Package purchased, the Property is marketed for up to 1 month, or until the Property is let, or the advert is extended by a further payment, or withdrawn, provided that:​​

    • There is one Instruction per service, per Property. You cannot use one Instruction to sell or let more than one Property, or one Instruction to both sell and let one Property.

    • The property is available within 4 weeks of being advertised

    • You respond to applicants within 24 hours. If applicants contact us repeatedly stating they have not been responded to within the specified time frame, Prosico reserves the right to remove the advertisement on the assumption that the Property is no longer available or that you are unable to deal with Applicants. The advertisement may be re-instated if requested and undertakings given that responses can be made within the specified time frame.

    • You will provide a current Energy Performance Certificate (EPC) for your Property, or evidence that a test for one has been arranged.

    • You will ensure a Gas Safety certificate is in place for the duration of the tenancy advertised.

    • You will provide EICR certification to the tenant at the point that this becomes mandatory and are best advised to pre-empt this anticipated legislation date.

    • You provide proof of ownership or proof of authority to act for the owner.

  5. Enquiries & Viewings

    • It is your responsibility to arrange viewings, to ensure your property is safe for visitors, and that you are confident of your own personal security and safety. You agree without reservation not to hold us responsible for any incidents that occur during a viewing.

    • Enquiries: we will make 3 attempts to contact Applicants to verify their contact details and then pass those details, with their consent, directly to you.

    • You will not use their contact details for any purpose other than to organise a viewing or answer any queries with regards to the property in question.

    • Screening and qualifying Applicants depends on your chosen Package and any screening criteria agreed with us.

    • Your contact details will not be disclosed to any Applicants, unless otherwise agreed in writing.

  6. Identity Requirements

    • You must be the owner of the Property you want us to market. You can instruct us if you are buying the Property but have not yet completed the purchase. You can instruct us on behalf of the owner if authorised to do so in writing, or a tenant at the property who wishes to expedite a move out. You will be required to submit ID to prove your status and ID for the owner if you are acting on his/her behalf. 

    • To comply with the terms of the Money Laundering Regulations of 2007 we may have to carry out identity checks on our customers which may require you to supply supporting information and evidence such as copies of passports, driving licenses, utility bills and bank statements. Failure to supply requested information will result in the termination of any service without refund of any monies paid and may result in the involvement of the police if we deem the circumstances suspicious. You understand and accept that we may undertake a search with Equifax for the purposes of verifying your identity. Equifax may check the details you supply against any database (public or otherwise) to which they have access. They may also use your details in future to assist other companies for verification purposes. A record of any search will be retained.

    • Right to Rent Checks: you are wholly responsible for undertaking checks regarding tenants’ immigration status to comply with right to rent obligations under section 22 of the Immigration Act 2014.

  7. Miscellaneous​

    • Property listed for sale may be visited by a Prosico representative if required, to verify all details, take photographs and draft floorplans. We will endeavour to get all Sales advertisements live within one working day of us visiting the property.

    • Our services offer no guarantee regarding the number of Applicants nor the possibility of a successful conversion of an Applicant to Tenant or Buyer.

    • Referencing: we rely entirely on suitably qualified third parties for referencing and cannot accept any responsibility for any error or omission in the result of a Tenant reference check. When instructing us to arrange a reference check for a Tenant you agree to this without reservation and agree to hold us wholly free of any liability.

    • We endeavour to keep the content of our website up to date and free of errors and misleading or conflicting information.

  8. Agreement

    • Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 we cannot begin to supply services until all obligations have been met where appropriate.

    • We reserve the right to amend these terms of use at any time without notification. Customers with Property being marketed at the time of a change of terms will be allowed 2 weeks to comply with any change that requires action on their behalf.

    • Any breach of these terms by you invalidates any rights you have under these terms and may result in the marketing of your Property ceasing immediately. If marketing of a property is ceased because of a breach of our terms, no refund will be given.

    • You agree that if any term contained in this agreement is found to be invalid by a court of law in England this does not invalidate any of the remaining terms.

    • By the acts of creating an account on our website and/or paying for any of the services or products you agree wholly and without reservation or exception to the terms and conditions above.​
